These terms and conditions are applicable to the sale of painting/s or artwork/s in any medium or form on the online gallery – www.artindia.co.in
General terms
The painting/s or artwork/s are made available for sale on the Website may not always be in the physical possession of artindia.co.in.
1. All artworks are made available for sale on the website does not include (direct or indirect) duties, taxes, insurance, packing, shipping and handling charges, which will be charged as applicable and would vary according to the size and weight (with packaging) of the art work and the freight according to the destination for shipment address provided by the buyer.
2. Artindia.co.in is the proprietor of www.artindia.co.in (Online Gallery), therefore In the event of sales all the invoices will be raised by artindia.co.in, on the buyer as per the information provided by the buyer.
3. Placing an order on www.artindia.co.in constitutes an irrevocable acceptance of the purchase . Unless rescinded/cancelled by www.artindia.co.in within 3 working days on account of a default by the seller or any prior or continuing breach by the buyer, such acceptance results in an enforceable contact of sale. The contract of sale is between (acting for self or as the agent of the Seller) and the buyer.
4. Once an order is placed on www.artindia.co.in the buyer is required to make payment to www.artindia.co.in, Delhi, Mumbai, Kolkata , India for the price of the artwork as well as the charges referred to above paras within 7 working days from the date of placing the order. In the event that www.artindia.co.in does not receive payment within 7 working days www.artindia.co.in reserves the right to cancel the order without prior notice to the buyer. Alternately, and without prejudice to the foregoing, www.artindia.co.in, at its absolute discretion, hold the artwork for the Buyer and charge any interest on the sale value, storage and insurance costs applicable on the purchase and/or may seek to commence legal proceedings (acting for self or as the agent of the Seller) to ensure execution of the contract of sale.
5. The artworks will be delivered/ shipped to the Buyer once all necessary documentation, relating to transportation, tax, etc. By Artindia.co.in are completed and payment has been realized in full including any additional charges. Transit insurance costs will be included in such additional charges, unless specifically advised otherwise by the Buyer. In the event that the buyer chooses to himself collect the artworks from Artindia.co.in he /she must do so within two weeks of Artindia.co.in receiving the payment. Once the art work is been delivered / shipped as per the instruction of the buyer the risk of transportation either by hand or by courier is borne by the buyer. In the event that the artworks are not so collected within a period of two weeks, storage and insurance costs will be applicable on the purchase and will be determined at the complete discretion of Artindia.co.in.
6. The Buyer agrees to abide by all provisions prescribed in the above terms and conditions and then make the payments to Artindia.co.in for the purchase of the art works . In particular, you warrant that all information that you submit will be true and accurate (including without limitation your credit card number and expiration date), and you agree to pay all costs, charges plus all applicable taxes for the purchases made by you.
7. The BUYER shall at all timers hereafter indemnify and keep Artindia.co.in fully indemnified against all claims, demands, actions, proceedings, losses, damages, costs, charges, expenses, interests and disbursements or any nature whatsoever which Artindia.co.in may pay or incur or suffer or sustain or be liable to pay or incur or suffer or sustain as a result or consequence, direct or indirect, of any inaccuracy in the credit card or in respect of any other mode of funds transfer.
8. All artwork displayed on the Website is supported by an authenticity guarantee from the collector/seller / Artist . Based on this, Artindia.co.in will issue a specific authenticity guarantee for every artwork sold on the www. artindia.co.in
9. The copy writes of the site www. Artindia.co.in owned by Artindia.co.in. Any misconduct or misuse of the site www. Artindia.co.in by any viewer / buyer or whomsoever is/are subjected to legal proceedings.
10 These Terms and Conditions of Use are governed by the laws of India. The Buyer hereby consent to the exclusive jurisdiction and venue of courts in India, India in all disputes arising out of or relating to the use of the Sites.
